On 8th September 2016, I made a new claim for Employment & Support Allowance, I requested backdating to 7th September 2016.
I was sent an ESA Customer Statement dated 8th September 2016, which I received in 16th September 2016.
On Page 2 of the ESA Customer Statement, it gives me the clear deadline of 8th October 2016 to provide evidence in support of my new claim, to the DWP.
Yet on 28th September 2016, “A” phones me from Worcester Benefit Centre. He’s already made the decision to refuse my new claim for ESA, despite their deadline of 8th October still being 10 days away!
I pointed out Page 9 of my ESA Customer Statement to “A”, which clearly lists a new medical complaint, but which, in his ignorance, he insisted I hadn’t mentioned when I made the claim on 8th September 2016. After a lengthy, fraught, discussion with “A”, he maintained I wasn’t entitled to ESA. He then rubbed salt into my wounds by backdating his flawed Decision to 7th September 2016.
I attached the Medical Certificate from my GP, & Page 9 of the ESA Customer Statement, which clearly mentions new condition.
Main Elements Of Complaint:
1. Decision made to refuse my claim made on 28th September 2016. Yet deadline DWP had earlier given me to submit evidence was 8th October 2016!
2. Decision Maker was stubbornly ignorant. Even after I’d discussed page 9 of ESA Customer Statement.
3. Effective Date of Decision was backdated to 7th September 2016.
