On 8th September 2016, I made a new claim for ESA, I requested backdating to 7th September 2016.
I was sent an ESA Customer Statement dated 8th September 2016, which I received on 16th September.
On page 2 of the ESA Customer Statement, it gives me the clear deadline of 8th October 2016 to provide evidence in support of my new claim, to the DWP.
Yet on 28th September 2016, “A” phones me from Worcester Benefit Centre. He’s already made the decision to refuse my new claim for ESA, despite their deadline of 8th October still being 10 days away!
I pointed out page 9 of my ESA Customer Statement to “A”, which clearly lists a new medical complaint, but which he insisted I hadn’t mentioned when I made the claim on 8th September 2016. After a lengthy, fraught, discussion with “A”, he maintained I wasn’t entitled to ESA.
I requested a copy of the Work Capability Assessment for this claim, & a full Statement of Reasons. I attached my Med Cert & page 9 of ESA Customer Statement.
[I have since made my (3rd) Claim for Income Support, & requested backdating of my I.S. Claim to 7th Sept 2016. But as the DWP haven’t yet processed my I.S. Claim, I’ve decided to request a Mandatory Reconsideration of ESA (6th) Claim, to cover every eventuality, and before deadline of one month expires.
If the DWP had already approved my new I.S. Claim (3rd) & backdated it to 7th Sept 2016, I probably wouldn’t have bothered requesting a Mandatory Reconsideration of ESA (6th) Claim Decision.]
